Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Bobos Mini Bites ("we", "us", "our"), based in Johannesburg, South Africa. By using bobosminibites.co.za ("the Site"), placing an order, or engaging us for catering, you confirm you are at least 18 years old (or have a parent/guardian's consent) and agree to these Terms. If you do not agree, please do not use the Site or our services.

We sell freshly handcrafted mini donuts, mini pancake skewers and related dessert catering for private events, parties and corporate functions in and around Johannesburg, South Africa. All product images on the Site are representative exact appearance may vary.

• ·We accept EFT and, where offered, card payments. Full instructions are included in your invoice.
• ·Late payment may result in cancellation of the booking with no refund of deposit.

• ·Changes to guest count or menu must be confirmed at least 5 days before the event and may affect pricing.
• ·If we cancel for any reason within our control, you receive a full refund of all amounts paid.

You must inform us of allergies or dietary requirements at the time of ordering. We are not liable for undisclosed allergies. Products are made fresh and best consumed within 24 hours of delivery.

Delivery times are estimates. Risk in the products passes to you on delivery or collection. You are responsible for providing safe access, a suitable setup area and refrigeration where requested in advance. Delays caused by you, the venue or events beyond our control do not entitle you to a refund.

Because our products are perishable and made to order, they are exempt from the standard cooling-off right under section 16 of the South African Consumer Protection Act.

You agree not to:

All content on the Site including the Bobos Mini Bites name and logo, photography, copy, and design is owned by us or our licensors and protected by copyright and trademark law. You may not use it without prior written permission, except for personal, non-commercial browsing.

If you tag us on social media, share a review or submit photos, you grant us a non-exclusive, royalty-free, worldwide licence to use that content for marketing purposes, with credit where reasonably practicable. You can revoke this permission at any time by emailing us we will remove the content within a reasonable period.

The Site is provided "as is" and "as available". We do not warrant that the Site will be uninterrupted, error-free or secure. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be excluded.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with any order is limited to the amount actually paid by you for that order. We are not liable for indirect, incidental, special or consequential losses (including loss of profits, data or goodwill).

You agree to indemnify and hold us harmless from any third-party claim arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

In line with US Federal Trade Commission guidance, we commit to:

1. Presenting prices, deposits, allergens and cancellation terms clearly before purchase.
2. Disclosing any sponsored, gifted or affiliate content with "#ad" or "#sponsored".
3. Honouring all advertised offers and prices.

Our Privacy Policy describes how we collect and use personal information. By using the Site you agree to that policy.

These Terms are governed by the laws of the Republic of South Africa. You agree to first contact us in writing to attempt to resolve any dispute. If unresolved within 30 days, the dispute will be referred to the courts of South Africa, without prejudice to your statutory rights under the Consumer Protection Act or your right to refer a matter to the National Consumer Commission.

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance.
